Software License Agreement

This Software License Agreement ("License") is between you and Brickstreet Music LLC ("Brickstreet Music," "we," "us"). It covers the desktop and mobile applications we publish, including their updates ("the Software"). By installing, activating or using the Software you agree to this License. If you do not agree, do not install or use it.

This License is in addition to our Terms of Service and Privacy Policy at brickstreetmusic.com. If they conflict about the Software, this License controls.

1. License grant

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software for the purpose it was made for, subject to this License.

The Software is licensed, not sold. We and our licensors keep all ownership of the Software and all intellectual property in it.

2. Downloading, trying and activating

The installer may be downloaded by anyone. Unlicensed copies may be limited in features or time, as described on the product page or in the app. Full use requires a valid license key.

A license key is created when you buy, is tied to the name on your order, and is checked by the Software on your device. Your key is for you (or the single organization named on it). Do not publish, share, resell or distribute it. One purchase covers the number of users or devices stated on the product page; if none is stated, one person, on the devices that person personally uses.

The licensed name appears in the Software. Choose a name you are comfortable showing on screen.

3. Restrictions

You may not: copy or redistribute the Software or your license key; sell, rent, lease, lend or sublicense the Software; reverse engineer, decompile, disassemble or try to extract the source code except where the law gives you that right despite this restriction; remove or alter copyright notices; bypass, disable or tamper with license checks or activation; use the Software to break the law or violate anyone's rights.

4. Updates

We may release updates, which may change, add or remove features. Updates are covered by this License unless they come with their own terms. The Software may check for updates by contacting our servers, as described in the app and our Privacy Policy.

5. Revocation and termination

This License lasts until it ends. It ends automatically if you break it. We may also revoke a license key if it was obtained by fraud, a payment is reversed or charged back, the key is shared or posted publicly, or this License is violated. When it ends you must stop using the Software and delete your copies.

If we revoke a key by mistake, contact us and we will fix it.

6. Your content and data

The Software works with files and information that you create or provide. You own your content. We do not claim any rights to it. You are responsible for backing up your own work.

7. Third-party components

The Software may include open-source or third-party components that have their own licenses. Those licenses apply to those components and are listed in the Software or on request.

8. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED OR SUITED TO ANY PARTICULAR EVENT, PRODUCTION OR PURPOSE. Some places do not allow these exclusions, so they may not apply to you.

9. Limit of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, BRICKSTREET MUSIC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, MISSED SHOWS OR EVENTS, OR BUSINESS INTERRUPTION, EVEN IF WE WERE TOLD THEY MIGHT HAPPEN. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SOFTWARE IS LIMITED TO THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some places do not allow these limits, so they may not apply to you.

10. Export and legal compliance

You agree to follow the laws that apply to your use of the Software, including export and sanctions laws. You may not use the Software where it is prohibited.

11. Changes to this License

We may update this License. For a new version of the Software we may ask you to accept the updated License before you continue. Continuing to use the Software after a change means you accept it. The version and date are shown at the top of this page.

12. Governing law

This License is governed by the laws that apply to Brickstreet Music LLC's state of formation in the United States, without regard to conflict-of-law rules.
